Announcement of sovereign wealth auction

The Police and border Guard Authority publishes a notice pursuant to paragraph 58(1) of the Law on State property (RVS).

The Police and border Guard Authority shall issue a public auction for the sale of public funds. The auction would be conducted in accordance with the Law on State assets and with order No 1-5/55 of the Secretary-General of the Ministry of the Interior, 09.05.2017, entitled “Procedure for the administration of State funds under the authority of the Ministry of the Interior” and on the basis of the Law on Weapons and order No 12 of the Ministry of the Interior, 18.03.2015, entitled “procedures for the realisation of expropriated weapons and ammunition”:
1. The Police and border Guard Authority shall launch a public written auction for the transfer of the following firearms:

2. The starting price of the auction shall be EUR 1040 (one thousand forty euros). All firearms referred to in point 1 shall be sold in a single batch. The winner of the public written auction shall be the
of the highest bidder for the whole batch of weapons3. The closing date for the submission of tenders shall be 09.02.2018 at 13:00. When a tender is submitted by post, the tender must be received by the closing date for submission of the tender. Tenders not received within the time limit shall not be opened and shall be returned to the tenderer's address for contact indicated on the envelope of the tender.
4. Participation in the auction shall be open to any legal person holding a licence to sell, manufacture, convert or correct weapons pursuant to paragraph 63(2)(4) of the Arms Act.
5. The winner of the auction is the person offering the highest price for the acquisition of public funds. If the conditions for the auction are met, the auction winner shall be awarded a sale contract within one month of confirmation of the auction result.
6. Following the publication of the public auction notice, any interested party may have access to the essential terms of the auction and the sale contract, as well as to the public assets to be sold.
7. Access to the property will take place between 10:00 and 12:00 hours on 31.01.2018 at the location of the property at the Police and border Guard Board Rahumäe tee 6, Tallinn. Applicants wishing to become acquainted with the assets sold shall give prior notice of their wish not later than 29.01.2018 to the e-mail address of the helen.nook@politsei.ee.
8. Contact Helen Nook, lawyer in the procurement and contract Service, at the phone 619 1239 or e-mail address in helen.nook@politsei.ee, in order to familiarise himself with the essential terms of the auction and the sale contract and obtain information.
. Participation in the auction shall be subject to the submission of a tender that fulfils all the conditions of the auction. Tenders must be submitted in a sealed envelope bearing the applicant's contact address and stating: 'disposal of public funds. Not to be opened before 13:00 on 09.02.2018.' The offer must be submitted to the Police and border Guard Board, Pärnu mnt 139, Tallinn, contact person Helen Nook. Bids submitted by e-mail shall not be accepted. At the request of the tenderer, proof of submission of the tender shall be issued to him.
10. The tender must contain the following information:
10.1 Declaration stating:
10.1.1 name, registry code, location and contact phone of the tenderer;
10.1.2 the amount bid, written in figures and words, without cents, which must not be lower than the initial price. Where the amounts written in figures and in words are different, the amount written in words shall be deemed to be valid;
;10.1.3 agreeing to participate in the auction and to purchase the assets to be auctioned under the conditions set out in the auction notice;
10.1.4 date of submission of tender; signature of the bidder and, where applicable, authorisation.
10.1.5 the postal address or email address to which the bidder wishes to obtain the documents and information relating to the auction. Where there is no indication of the postal or e-mail address for the transmission of the documents and information relating to the auction, the documents or information shall be sent to the postal address indicated in accordance with point 10.1.1; the
shall:10.1.6 a declaration signed by the tenderer that he is aware of the state of the property and that he has no complaints in that regard to the seller.
11. Tenders which do not meet the conditions laid down in these Rules or which are incomplete shall be considered irregular and shall not take part in the auctions unless they are manifestly inaccurate and do not affect the conduct of the tendering procedure.
12. The tender must be valid for 30 days from the closing date for the opening of the tender.
13. On the day the tenders are submitted, the envelopes submitted to the auction shall be opened in the order in which they are registered and the content of the tenders shall be recorded in the auction record.
14. Tenders which have not been received by the deadline or which do not meet the conditions set out in the auction notice shall not be admitted to the auction. Any tender submitted within the time limit but not complying with the requirements shall be noted in the auction record as to the reason for its non-participation.
15. Where two or more participants in an auction have submitted an equal highest bid, an additional auction round shall be held between them within ten working days. The initial price for the additional round shall be the highest bidding price offered in the first round.
16. If the highest bidder withdraws the bid during the tender procedure, materially infringes the terms of the tender or fails to pay the bid price by the deadline set, the seller shall be entitled either to declare the next highest bidder or to declare the auction unsuccessful.
17. The auctioneer shall communicate the outcome of the auction in writing to all bidders within 5 working days of the opening of tenders and send it to the address indicated in the bidder's application.
18. The auctioneer shall decide, by means of an order, within 20 working days of the expiry of the deadline for the submission of tenders, whether or not to confirm the outcome of the public auction, including for reasons of failure. If the outcome of the auction is not confirmed, the reason shall be indicated. The decision shall be notified to the auction participants without delay.
19. The auctioneer shall declare that the auction has failed and shall refrain from confirming the outcome of the sale by public auction in the event of a breach of the rules laid down by law or a deviation from the conditions of sale as follows:
19.1 No tender or valid tender was submitted;
19.2 the auctioneers failed to comply with the auctioneer's instructions or violated the rules governing the auctioneering procedure;
19.3 the auction revealed an agreement or concerted practice between the participants which had or could have had a significant influence on the outcome of the auction.
