Notice of initiation of the mining authorisation procedure

The Environment Agency publishes a notice under paragraph 47(2) of the General Law on the Environment (KeÜS).

The Environment Agency notifies that THE APPLICATION for AMENDMENT of THE environmental permit for Mining (“mining permit”) No L.MK/321798 submitted by SANDPIT OÜ (registry code: 11318414) (address: Jõgeva County, Põltsamaa Municipality, Põltsamaa City, Mäe tn 7, 48105) on 01.10.2018 (registered on 01.10.2018 under document management system No 12-2/18/15973 of the Environment Agency).

SANDPIT OÜ holds mining authorisation No L.MK/321798 (valid from 14.05.2012 to 13.05.2027) for the extraction of building gravel, building sand and filling sand in the Jaaka III mountain deposit. The main mineral resource is a building gravel. The area of use of mineral resources is road construction and general construction works. The mountain allocation of the jac III sandstone is located in the municipality of West Nigula in the village of Jaakna on the State-owned cadastral parcel of the Jaakna gravel deposit (cadastral Identifier 68001:002:0176, the intended use of the land at 100% of the extractive land), managed by the Ministry of the Environment and the Autorità Land. The mountain allocation of the Cypriot Cup III is 7.82 ha and the service area of the mountain Cup III is 7.82 ha. The mining permit is valid until 13.05.2027.

The present request concerns the designation of the beach quarry of Jaaka III as a gravel quarry of Jaaka III, the mountain area of 13,39 ha, the service area of the mountain area of 14,87, the average annual mining rate of 89 hrs m3, the construction and construction of roads for the intended use of the mineral, the conversion of the mountain and terrain reserves and the extension of the mining authorisation until 13.05.2032.

The requested mountain allocation consists entirely of blocks 6 and 9 of the active consumption of building sand on the Jaaka gravel deposit (event No 0316) and of blocks 7 and 10 of the active consumption of building gravel and in depth of the existing extraction of the Jaaka III sand quarry (extraction permit No L.MK/321798).

The draft amendment to the mining permit shall be prepared and published by the Environment Agency in the Official Gazette Ametlikud Teadaanded. The drafts shall also be sent to the municipality and the applicant for authorisation for inspection and for submission of proposals.

In accordance with paragraph 46(1) of the General Law on the Environment, in the event of an open procedure, the consent authority must notify the person whose rights may be infringed or whose obligations may be affected by the grant or refusal of an environmental permit, including the owner of the land adjacent to the land on which the proposed activity is located, of the application for an environmental permit.

The interested party and the person whose rights may be affected by the proposed activity shall have the right, from the date of publication of the notices until the conclusion of the procedure, to submit to the Environment Agency proposals and objections to the request for amendment of the authorisation to exploit the mineral resources or to the draft authorisation.

The decision to initiate the procedure for amending the mining permit and other relevant documents can be consulted at the nearest Office of the Environment Agency (+372 452 7773, info@keskkonnaamet.ee).
The application is available digitally in the public document Register of the Environment Agency at https://dhs-ADR-kea.envir.ee/ (title Jaakna III gravel quarry).

Until such time as a decision is taken to amend or refuse to modify the mining permit, everyone has the right to submit reasoned proposals and objections to the application to the Environment Agency. Proposals and objections may be submitted orally or in writing to an e-mail address at the info@keskkonnaamet.ee address or postal address Tallinn 22, Kuressaare, the municipality of Saaremaa, the island region 93819.

The draft decision amending the mining permit will be further notified by the Environment Agency in the Official Gazette Ametlikud Teadaanded.
