Announcement of sovereign wealth auction

The Maa-amet's Office publishes a notice pursuant to paragraph 58(1) of the Law on the property of the State (RVS).

The Maa-amet shall issue a public auction for the use of immovable property under the authority of the Ministry of the Environment in accordance with the Law on State property and Decree No 14 of the Minister for the Environment of 28.04.2010 entitled “Procedure for the supply and use of immovable property under the authority of the Ministry of the Environment” (Procedure):
pursuant to Decree No 1-2/19/510 of the Minister for the Environment of 23.07.2019, the following immovable property under the authority of the State-owned Ministry of the Environment shall be granted for agricultural use:

Any person may participate in the auctions subject to the limits laid down by law.

An auction participant shall, before making an offer, be required to:
1. closely examine the immovable property in nature. A property may be inspected in nature at any time if the auction notice does not specify separately the time and conditions of access to a particular property. In the event of a refusal to examine the immovable property and the data relating to it, the tenderer cannot subsequently claim that he was unaware of the condition of the property;
2. have access to information on the subject matter to be leased published on the website of the Land Board, including the information on the restriction card and any accompanying documents;
3. examine the terms of the auction published on the website of the Land Authority. By signing a declaration of participation in the auction, the participant declares that he is aware of and accepts all the terms of the auction;
4. examine the draft lease published on the website of the Land Authority;
5. pay the deposit no later than the closing date for the submission of the bid, in the amount and in accordance with the procedure set out in the auction notice, and provide a copy of the order for payment of the deposit, indicating the information required;
6. submit, within the time-limit, a tender to the Earth's Office in accordance with the terms and conditions published in the Official Journal and on the website of the Earth's Office.

The land is given for agricultural use for a fixed term; the lease contract expires on 01.10.2024.

We recommend that an application to participate in the auction be made using the form set out in the notice published on the website of the Earth Authority. An application to participate in an auction must state:
(1) name of tenderer;
(2) the tenderer's personal identification number or registry code;
(3) contact address, contact telephone and, if available, e-mail address;
(4) the name and cadastral identification of the leased item;
(5) the address at which the documents are sent (postal address or e-mail address to which the auctioneer sends the notices and documents relating to the auction;
(6) the amount of the tender written in figures and words, expressed in whole number in euros (without cents). The tender must not be less than the initial price.
Where the amounts written in figures and in words differ, the amount written in words shall be considered valid.
Where the bid amount is provided with sents, only a full amount shall be taken into account as the bid amount;
(7) acceptance of the conditions for participation in the auction and the making available of immovable property set out in the auction notice;
8. the date on which the offer was made;
(9) the signature of the bidder;
If the application is signed digitally, the application and the digital signature endorsement must be printed out, inserted in a sealed envelope and forwarded to the earth's office. In this case, within one working day of the closing date for the opening of tenders, a digitally signed application (whole digital container) must be sent by e-mail to the earth's office in maaamet@maaamet.ee;
(10) the number of the current account to which the deposit is returned if the deposit is paid by transfer from a foreign bank or in cash to a bank.

At the time of an auction, both a legal person and a natural person may also bid through a representative who has been granted a right of representation in a form that can be reproduced in writing. In order to participate as a representative of another person, the application to participate in the auction must state:
• the name, personal or registry code and contact address and contact phone of the tenderer - enter the details of the person on whose behalf the offer is made and who enters into the lease of the property.
• address for sending documents: the address of either the principal or the representative, depending on the address at which the bidder wishes the auctioneer to send the documents and notices relating to the auction.
• signature of the bidder - enter the name and signature of the bidder or authorised representative.
• as regards the remaining conditions to fill in the request for participation in the auction in the same way as participation in its own name.

Participation as a representative shall be subject to the presentation of an authority of attorney attesting to the right of representation together with the application for the auction. In the case of a signed power of attorney, a digital signature endorsement must also be attached and, in order to check the data, the entire digital container must be sent to the maaamet@maaamet.ee by the closing date for submission of tenders. The organiser shall be entitled to request a power of attorney even after the closing date for the submission of tenders, where appropriate.

The power of attorney need not be filed if the right of attorney of the bidder on behalf of the company is recorded in the electronic commercial register. If the person who made bids in the name of another person did not have a right of representation at the time the bid was made, he shall not be considered to have participated in the auction.

No later than the closing date for submission of a bid, the participant shall pay the amount of the deposit and the bank transfer details specified in the auction notice. The deposit must be paid separately for each item of rent in the form of a separate payment into a bank account held by the Ministry of Finance:

Payment must be made by specifying, as stated in the auction notice, the
:• Reference number: 10917110000002,
• Explanatory Memorandum “lease, name of the lease object and/or cadastral identification”;
• If the payment is made for another person, please include in the explanation the name of the tenderer for whom the payment is made.
When the deposit is paid in cash to or by transfer from a foreign bank, the application for participation must state the IBAN code, the name of the bank (if the deposit is paid from a foreign bank), the name of the account holder and the account number to which the deposit is to be returned. A copy of the order for payment of the deposit must be submitted with the application to participate in the auction in a sealed envelope.

Tenders must be submitted or sent by post no later than 01.10.2019 at 10:30 at Akadeemia 4, Tartu 51003. Tenders must be submitted for each leased item in a sealed envelope, stating:
• contact details of the tenderer;
• object name and cadastral identifier for which the tender is submitted;
• the warning “not to open an auction before 01.10.2019!”

In the case of dispatch by post, only the bids sent by the postal service provider to the Land office within the time-limit laid down shall be taken into account.
By confirming the bid, the bidder undertakes to pay the rent offered for the leased item and to conclude the lease on the terms and within the time limits set out in the auction notice.
Participants in the auction shall be associated with their bid from the time they bid until the outcome of the auction is confirmed. The person or persons in whose favour the results of the auction are confirmed shall be bound by their tender until the contract is awarded.

The opening of written tenders will take place on 01.10.2019 at 11:00 in the Hall of floor I of Academy 4 in Tartu. The opening of tenders shall be in the public domain.

Only tenders submitted within the time limit and in accordance with the requirements laid down shall be taken into account. The bidding envelope delivered to the earth authority after the required time limit is returned to the sender without opening it.

Tenders submitted shall not be taken into account and a tenderer shall not be considered to be a participant in the auctions if any of the following defects occur:
• the offer is submitted or brought to the earth authority by the postal service provider after the required deadline;
• the envelope submitted cannot be understood to contain an offer and to which object;
• the deposit has not been paid by the deadline for submission of the tender;
• the error in the payment of the deposit does not make it possible to establish whether it has been paid into the correct account, under the correct reference number and in the amount claimed;
• the bid amount submitted is below the initial price;
• in the case of representation of another person, there is no right of representation to submit a tender;
• some of the requested documents are not submitted or are presented with deficiencies and it is not possible to determine whether the conditions for the auction are met.

The written lease must be concluded within 2 months of the date on which the outcome of the auction is confirmed. The lease is for a fixed term and expires on 01.10.2024.

The rules governing the determination of the outcome of the auction, the application of the privileges arising from paragraph 66(7) and paragraph 105(2) of the RVS, the confirmation of the outcome of the auction, the payment and reimbursement of the deposit and the conclusion of the contract are set out in more detail in the terms of the auction, which are www.maaamet.ee published at the address on the website of the Land Authority and which the participant is required to consult before making the offer.
More detailed information on the leased properties or participation in the auction can be obtained by telephone from the telephones mentioned in the notice of auction published on the website of the Land Authority:
• on leased properties and participation in auctions before the closing date for the submission of tenders.
• on other issues related to the auctions on each working day.
Written questions concerning the tenancies of immovable property or the conditions for participation in the auction must be submitted no later than five working days before the closing date for the submission of tenders at the e-mail address to the maaamet@maaamet.ee or at the postal address Akadeemia 4, 51003 Tartu.
