Kohtutäitur Kaire Põlts publishes this announcement under Subsection 2 of § 84 of the Code of Enforcement Procedure (TMS).

The bailiff sell the following assets in a https://www.oksjonikeskus.ee in the auction environment of the Chamber of bailiffs and bankruptcy administrators electronic auction:
Tallinna kohtutäitur Kaire Põlts sells a movable belonging to PEETER KUDRIN in an electronic auction centre online at the address in the e-auction environment of bailiffs and bank administrators (online at https://www.oksjonikeskus.ee/): 3/16 conceptual part of the estate belonging to debtor KUDRIN PEETER on 30.09.2017 KUDRIN PJOTR (35612300259), who died from the community of the estate (certificate of succession No 1233 of 10.11.2017 has been prepared concerning the succession), incl. the claim of the debtor against the co-successors for the division of the estate has been seized. The co-successor (ies) of the joint estate is: 5 co-successors in addition to the debtor. As far as the bailiff is aware, the following immovable property belongs to the common heritage: the registered immovable at Viljandi County, Mulgi Rural Municipality, Abja-Paluoja City, AIA tn 44, reg.osa nr 2040339, kat.tun NUS 10701:002:1090, area 5562.0 m2. OKAY! The immovable belonged to the joint ownership of the bequeather with the spouse. The actuator does not have information on the conduct of the inventory of the estate. Note: the spouses' property relationship had an asset relationship of property commonality with respect to the bequeather. The aforementioned property was part of the joint property of the spouses. The heirs are listed in the succession register, which is available here: https://www.notar.ee/et/registrid/parimisregister. A notation concerning the prohibition on disposal of property registered on behalf of the debtor has been entered in the register in the course of the present enforcement proceedings. A notation concerning prohibition on disposal shall be deleted after the auction has been declared to be the best. Persons who have rights to the thing to be sold shall notify the bailiff thereof before the auction and, upon request of the bailiff, state the reasons therefor. Persons who have rights hindering the auction shall reach an agreement with the claimant or, on the basis of a court decision, terminate or suspend the auction before the day of distribution of the result. Upon acceptance of the succession, all rights and obligations of the bequeather shall be transferred to the successor, except those which by their nature are inextricably related to the person of the bequeather or which, pursuant to law, cannot be transferred from one person to another. Therefore, the estate belonging to the bequeather has also been transferred to the successor (debtor) to the extent specified in the certificate of succession law (basis: § 130 (1) of the succession Act). Any co-successor may demand the division of an estate, unless otherwise provided for in § 155 of this Act. Upon division of an estate, it shall be determined which things or parts thereof are included in the estate, as well as the rights and obligations remain with each co-successor. The estate shall be divided between the successors according to their share of the estate on the basis of the usual value of the items forming part of the estate at the time of division. Upon agreement of the successors, a thing forming part of an estate may be assessed on the basis of the special interest of the successor. Upon division of an estate, the provisions for division of a thing in co-ownership apply unless otherwise provided by this Act. Co-successors shall share the estate by agreement. In the event of a dispute, the estate shall be divided by a court at the request of the successor (basis: § 152 of the succession Act).

The deposit paid by the buyer shall be included in the purchase price and returned to the other participants in the auction on the working day following the day of the auction

A personl be registered as an auction participant if the application for registration and the necessary annexes to the application meet the conditions for the auction , deposit paid and the person may participate in the auction as a bidder.

Bids can only be made in the auction environment according to the conditions indicated in the auction environment.
 
The winner of an electronic auction pay the purchase price as soon as the auction is completed, as pursuant to §93(3) of TMS. If the purchase price exceeds EUR 12 700, the auction winner must pay one tenth of the purchase price immediately after the end of the auction, the remaining price having to be paid within 15 days. If the purchaser is the debtor, he or she must immediately pay the full purchase price.
 
THE RIGHTS OF THIRD PARTIES
Before the start of the auction, the person must inform the bailiff of his or him rights to the thing to be sold if it have not yet been notified to the bailiff, and the reasons for those rights should be given at the request of the bailiff. Persons holding rights which impede the auctioning shall, in agreement with the claimant or on the basis of a court decision, obtain the termination or suspension of the auctions before the day on which the result is distributed.
