fishing opportunities in
auction


The decree is adopted on the basis of paragraph 131(3), paragraph 134(2), paragraph 44(3) and paragraph 49(1)(1) of the Law on the Government of the Republic, paragraph 8(2)(1) of Decree No 264 of the Government of the Republic of 30 July 2004 entitled “Statute of the Ministry of Agriculture” and paragraph 1(1) and paragraph 2(1) and (3) of Decree No 414 of the Government of the Republic of 12 December 2000 entitled “Procedure for the auctioning of professional fishing opportunities”, and in accordance with paragraph 16(3) and (5) of the Law on fishing, Council Regulation (EU) No 23/2010 fixing for 2010 the fishing opportunities for certain fish stocks and groups of fish stocks, applicable in Union waters and, for Community vessels, in waters where catch limitations are required, and amending Regulations (EC) No 1359/2008, (EC) No 754/2009, (EC) No 1226/2009 and (EC) No 1287/2009 (OJ L 21, 26.1.2010, p. 1-120; OJ L 24, 28.1.2010, p. 14), Annex IC and Decree No 31 of the Minister for Agriculture of 11 February 2010 'Restitutio in integrum of the deadline for lodging an application for a professional fishing permit'
.
1. Sell at the oral auction 173 tonnes of redfish (RED) fishing opportunities for 2010 in Northwest Atlantic Fisheries Organisation (NAFO) zone 3LN as follows:
(1) 87 tonnes of redfish (RED) — with a starting price of 39 150 EEK (thirty nine thousand and fifty hundred and fifty);
(2) 86 tonnes of redfish (RED) — with an initial price of 38 700 (thirty-eight thousand seven hundred) EEK.

2. As referred to in point 1:
(1) the oral auction of redfish (RED) fishing opportunities shall take place on 6 April 2010 at 12.00 in the floor of the second floor of the Ministry of Agriculture at lai tn 39// lai tn 41, Tallinn. Registration as a bidder begins 11.00 and ends 11.45 in the floor of the second floor of the Ministry of Agriculture at lai tn 39// Lai tn 41, Tallinn;
(2) the minimum bid step is EEK 5000 (five thousand) and the maximum step is EEK 25000 (twenty-five thousand);
3. the participation fee shall be 300 (three hundred kroons) and the deposit shall be 50% of the starting price of the redfish (RED) fishing opportunities in the
.
3. To sell at auction 61 tonnes of cod (COD) for 2010 in the Northwest Atlantic Fisheries Organisation (NAFO) zone 3M as follows:
(1) 31 tonnes of cod (COD) — with an initial price of 15 500 EEK (fifteen thousand five hundred);
(2) 30 tonnes of cod (COD) — with an initial price of EEK 15 000 (fifteen thousand).

4. As referred to in point 3:
(1) the oral auction of fishing opportunities for cod (COD) shall take place on 6 April 2010 at 14.00 in the floor of the second floor of the Ministry of Agriculture at lai tn 39/lai tn 41, Tallinn. Registration as a bidder begins 13.00 and ends 13.45 in the floor of the second floor of the Ministry of Agriculture at lai tn 39// Lai tn 41, Tallinn;
(2) the minimum bid step is EEK 5000 (five thousand) and the maximum step is EEK 25000 (twenty-five thousand);
3. the participation fee shall be 300 (three hundred kroons) and the deposit shall be 50% of the starting price for fishing opportunities for cod (COD).

5. The participation fee and the guarantee fee referred to in points 2(3) and 4(3) shall be paid into Treasury account No 10220034799018, SEB Bank, reference No 3100054717, or into Treasury account No 221013921094, Swedbank, reference No 3100054717, mentioning the beneficiary 'Ministry of Finance' and the explanation 'auction premium and guarantee fee' by 5 April 2010 at the latest by the
of 5 April 2010.
6. The winner of the auctions shall be the person who offers the highest purchase price. Securities paid by the auctioneer shall be taken into account as a set-off against payment of the purchase price of the fishing opportunities acquired. The securities shall be returned in full to the other bidders within five calendar days of the confirmation of the auction results. The sum secured shall not be returned to the person responsible for the failure of the auction. Participation fees shall not be refunded to the

7. The successful bidder must pay the purchase price offered by him in full within ten calendar days of his appointment as the winner of the auction into account No 10220034800017 of the Ministry of Finance, SEB Bank or account No 221023778606, Swedbank, reference 2800076261 (distance fishing), and submit to the Ministry of Agriculture, within the same period, a document certifying payment of the purchase price
.
8. Persons who, by 26 February 2010 at the latest, have submitted an application for a fishing licence for redfish (red) in Northwest Atlantic Fisheries Organisation (NAFO) zone 3LN and/or cod (COD) fisheries in Northwest Atlantic Fisheries Organisation (RED) zone 3M.
shall be eligible to participate in the auctions referred to in points 1 and 3, in accordance with Decree No 31 of the Minister of Agriculture of 11 February 2010 entitled “Restatement of the deadline for lodging an application for a professional fishing permit”.
