The order shall be issued on the basis of paragraph 19(6) of the “Law on fishing”.


According to paragraph 131(1)(5) of Decree No 150 of the Government of the Republic of Lämmi October 2010 entitled “opportunities for commercial fishing and permitted annual catches for 2011 under a fisherman's fishing licence for fishing in the lakes of Peipsi, Läm and Pihkva and in the Baltic Sea and the Gulf of Liste”, 'under the Agreement between the Government of the Republic of Estonia and the Government of the Russian Federation on cooperation for the conservation and exploitation of fishery resources in lakes of Peipsi, Lämmi and Pihkva, Lämmi tonnes of
per year are allocated to the Republic of Estonia.
According to the information provided by the Government of the Republic in accordance with the procedure laid down in Regulation No 104 of 31 March 2003, entitled “Procedure for reporting data on fishing”, 653 tonnes have been caught in lakes Peipsi, Läm and Pihkva by 17 October 2011. Thus, paragraph 131(1)(5) of Decree No 150 of the Government of the Republic of 21 October 2010, Lämmi “opportunities for commercial fishing and the annual allowable catches for 2011 under a fisherman's fishing permit for fishing in the lakes of Peipsi, Läm and Pihkva and in the Baltic Sea and Gulf of Livi”, has exhausted at least 90% of the annual allowable catch of that
.
Paragraph 19(6) of the Law on fishing requires the Minister for Agriculture to stop commercial fishing in waters where the annual allowable catches for that area have been exhausted by at least 90%. Commercial fishing may be suspended in respect of one or more areas, small permanent islands, gears, species of fish and fishing authorisations referred to in paragraph 13(3) of the 'Law on fishing'.

For fishing activities carried out under a fishing authorisation of a fisherman, the main fishing gear for the area of the lakes of Peipsi, Lämmi and Pihkva shall be a gillnet or framework network, a net, a longline, a bottom seine or a mutton, a turning net and an shore seine. These gears shall be of a low selective nature, which, if captured, shall not prevent the presence of a position in the gear. Similarly, it is not possible to release the gear from the trap as viable for the place occupied by those gears. It is therefore necessary to stop fishing with those gears in lakes of Peipsi, Lämmi and Pihva
.
1. I shall stop fishing on the basis of a fisherman's fishing licence in the lakes of Peipsi, Lämmi and Pihkva from the day following publication of the circular in the Official Teadaanded.

2. I shall stop fishing activities carried out in lakes of Peipsi, Lämmi and Pihkva under a fisherman's fishing authorisation with a gillnet or framework netting, a net, a long line, a bottom seine or a mutton, a turning line and a shore seine.

3. The circular applies to persons fishing on the basis of a fisherman's fishing licence in the lakes of Peipsi, Lämmi and Pihkva.

4. Order the publication of the circular in the Official Journal of the Ministry of Agriculture and on the website of the Ministry of Agriculture,

The order may be the subject of a complaint to an administrative court within 30 days of publication of the order in the Official Teadaanded of the European Communities, in accordance with the procedure laid down in the Code of Administrative Procedure.
