ORDINANCE OF the Ministry OF Agriculture OF 22.09.2014 No 129
Suspension of by-catches of 2014 cod in the North-East Atlantic in ICES Subdivisions I and IIb

The decree is issued on the basis of paragraph 19(6) of the Law on fishing:

Pursuant to Annex IB to Council Regulation (EU) No 43/2014 fixing for 2014 the fishing opportunities for certain fish stocks and groups of fish stocks, applicable in Union waters and, for Union fishing vessels, in certain non-Union waters (OJ L 24, 28.1.2014, p. 1-145), for 2014 for European Union cod in the North-East Atlantic ICES Subdivisions I and IIb (COD/1/2B.) is 36 908 tonnes. Of which 36 658 tonnes are designated as fishing opportunities for Spain, Poland, Portugal, France, Germany and the United Kingdom and the remaining 250 tonnes as fishing capacity for all other Member States
.
According to catch data submitted in accordance with the procedure laid down in Article 47 of Commission Implementing Regulation (EU) No 404/2011 laying down detailed rules for the implementation of Council Regulation (EC) No 1224/2009 establishing a Community control system for ensuring compliance with the rules of the Common Fisheries Policy (OJ L 112, 30.04.2011, p. 1-153), by 21 September 2014 246,5 tonnes of cod are caught in the waters of Barents in ICES subdivision I under the fishing authorisation of an Estonian fishing vessel. According to the European Union Fisheries database (FIDES), as of 21 September 2014, other Member States have not made use of the fishing opportunities allocated to other Member States for cod in ICES Subdivisions I and IIb in the
.

Given that at least 246,5 tonnes of cod have been caught, the cod quota allocated to other Member States in ICES Subdivisions I and IIb of the North East Atlantic, as set out in Annex IB to Council Regulation (EU) No 43/2014, has exhausted at least 98,6% of the
quota.
Under paragraph 19 (63) of the Law on fishing, once the fishing opportunities allocated to the Republic of Estonia or the European Union under international agreements and used by Estonian economic operators have been exhausted and the State or the European Union has an obligation to prohibit or terminate fishing activities in that area, the Minister for Agriculture is to prohibit and terminate fishing activities by order of the
if the European Union has not stopped fishing activities.
Paragraph 19(6) of the Law on fishing requires the Minister for Agriculture to stop commercial fishing in the water area once the fishing opportunities for that area have been exhausted by 90%. Commercial fishing may be suspended in respect of one or more areas, small permanent islands, fishing gear, species of fish and fishing authorisations referred to in paragraph 13(3) of this Law.
