Notification of the granting or refusal of a specific water use permit

The Environment Agency publishes a notice under paragraph 9 ¹ (5) of the water Act (water). The additional basis for publication of the notice is paragraph 12(1)(2) of the Law on environmental impact assessment and management.

The Environment Agency reports that the nature of the non-profit-making association Laidevahe (registry code: 80168498) (address: Siiksaare village, Valjala rural district, island district, 94301) has been amended without an environmental impact assessment by way of special water use permit No L.VV/326229, valid from 19.08.2015 to 31.12.2016. Under special amended water use permit No L.VV/326229, it is permissible to carry out the necessary works in the Oessaare Bay, Enima eye and Rõrõrõrõrer bridge in the Oessaare Bay until 14 November, if climatic conditions allow. Establish a barrier to prevent water leakage from sediment and mixed sediment. If the sediment is returned, stop work and implement further measures as a major step towards its recovery (e.g. the construction of an additional Vall or the installation of a temporary geomembran, etc.). Works may not be carried out during periods of rain or high water quality and must be carried out in such a way as to avoid disturbing the warm which is preparing for migration. The Environment Agency considered the need to initiate an environmental impact assessment in accordance with paragraph 6(1) of the Law on environmental impact assessment and Management systems and paragraph 11 of Decree No 224 of the Government of the Republic of 29.08.2005, entitled “list of activities subject to a preliminary assessment of the need for an environmental impact assessment”. In view of the Riga fractures (unit environmental technology, BSC, licence No KMH0147) and Mari Raidla (EEC landscape conservation and maintenance), the preliminary environmental impact assessment has been supplemented by a project entitled “opening of the Lõve estuary and restoration of habitats”. The EEA agrees with the results of the ex-ante assessment and concludes that it is not necessary to initiate a full environmental impact assessment of the modification. The revised ex-ante environmental impact assessment has assessed the environmental effects of the proposed operation on the basis of all the criteria set out in paragraph 6(3) of the KeHJS and requires work under Chapters 4.1.1 and 4.2 of the Plan 2011-2020 for the Conservation of the Walloon nature reserve and the Siiksaare-Oessaare site. The laying of the estuary of the River Way and Silmaye, the partial cleaning of the sediment of the Gulf of Oessaare and the laying of stone weds in the water bodies connecting the Gulf of Oessaare and the Gulf of Laideal (Enima eye and Rõrõrõrõrõrway eye) is necessary for the management of the conservation area of the Laideal margin and the conservation area of the Siiksaare-Oessaare site (the urban area of the Gulf of Siiksaare-Oessaare and the Isaare-Oessaare. The authorities concerned have not submitted any remarks to the Environment Agency in relation to the completed preliminary environmental impact assessment
