The circular is established on the basis of paragraph 34(1) and (4) of the 'Administrative Procedure Act', paragraph 131(3) of the 'fishing Act' and paragraph 49(1)(3) of the 'Government of the Republic Act' and in accordance with Council Regulation (EC) No 23/2010 fixing for 2010 the fishing opportunities for certain fish stocks and groups of fish stocks applicable in Union waters and, for Community fishing vessels, in waters where catch limitations are required and amending Regulations (EC) No 1359/2008, (EC) No 754/2009, (EC) No 1226/2009 and (EC) No. No 1287/2009 (OJ L 21, 26.1.2010, p. 1-120), Annex IC.

At the meeting of the Northwest Atlantic Fisheries Organisation (NAFO), it was agreed to open the redfish (RED) fishery in NAFO 3LN, where the Republic of Estonia was allocated a fishing capacity of 173 tonnes for redfish (RED) by Council Regulation (EC) No 23/2010, and cod (COD) in NAFO 3M, where a fishing capacity of 61 tonnes for cod (COD) was allocated to the Republic of Estonia. Fishing for those species in the areas indicated has been prohibited for more than 10 years, so that it is not possible to allocate the fishing opportunities allocated to the Republic of Estonia in accordance with paragraph 16(3) of the Law on fishing
.
Council Regulation (EU) No 23/2010 setting out the abovementioned fishing opportunities entered into force after the expiry of the deadline for the submission of applications for a professional fishing licence for fisheries in 2010, i.e. after 1 December 2009, which is a valid reason for reinstating the deadline for the submission of applications for a fishing licence to applicants interested in fishing for redfish in NAFO 3LN and cod in NAFO 3M.


1. Applications for a professional fishing authorisation for redfish (RED) in 2010 under a fishing authorisation of a fishing vessel in NAFO 3LN and cod (COD) under a fishing authorisation of a fishing vessel in NAFO 3M may be submitted in accordance with established procedures from the date of publication of the circular until 26 February 2010 at the latest.
