Notice of auction of immovable property in enforcement proceedings

Kohtutäitur Elin Vilippus publishes this announcement under paragraph 153(2) of the Code of enforcement Procedure (TMS).

The bailiff sell the following assets in a https://www.oksjonikeskus.ee in the auction environment of public bailiffs and the Chamber of Bank administrators electronic auction:
Unbuilt land owned by Andrus Narusk, located in Kotka, Restu village, Municipality of Otepää
The property is entered in the register part of the land registry department of Tartu District Court No 2578140 (cadastral identification 72401:003:0024) for 100% of arable land, the maakond of Valga, the municipality of Otepää, the village of Restu, Kotka.
Land area 3.79 ha.

Immovable property not built on.

According to the Land Administration's restriction Card, an electric overhead line runs from the edge of the land. The property is accessible from a public road (No 23195, Otepää-Kääriku-Kurevere).

The parties to the proceedings have indicated that, according to the Ministry of the countryside, the Kotka site is located in the Otepää natural park, the Vanamõisa-Restu limitation zone. The restriction zone is the nature conservation zone with the most lenient conservation regime. Decree No 135 adopted by the Government of the Republic on 01.12.2016.a? Paragraph 17 of the Otepää Conservation Law? provides that construction in a restricted zone is authorised with the consent of the manager of the protected site (the Environment Agency). With the consent of the manager of the protected site, it is also possible to modify the intended use of the cadastral parcel, establish a building plan and authorise the construction of a building (paragraph 6 p 1, P 3, P 4 of Regulation No 135).

Encumbered third-party rights, with their ranking, and other restrictions on the ownership of immovable property:
Section III, entry No 1 - immovable property is encumbered with the right of pre-emption provided for in paragraph 16(5) of the nature Conservation Act in favour of the Republic of Estonia. 5.02.2014 entered on the basis of the application for registration of 7.02.2014;
In Section III, entry No 2 - a non-profit-making association to prohibit the disposal of immovable property in favour of the Estonian motor Insurance Fund (registry code 80206477), Rita Lohui (personal identification number 46107116016);
In Section III, entry No 3 - a prohibition clause prohibiting the disposal of immovable property in favour of Kätlin Sütiste (personal identification No 46806110235);
In Section IV, rank 1: a judicial mortgage in the amount of EUR 15 000,00 in favour of Kätlin Sütiste (personal identification No 46806110235) in order to secure the claims in civil case No 2-19-1786. 4.12.2019 entered on the basis of the consent of the order of 13.01.2020, 29.01.2020.

The auction shall take place in order to satisfy the prohibitions and mortgage-backed claims. Any mortgages or prohibitions on the property shall be extinguished after a successful auction..

The deposit shall be deemed to have been settled when it is received. The deposit must be lodged no later than 29.03.2022 at 12:00. Subsequent receipts shall not be counted. Securities paid by the buyer shall be included in the purchase price and returned to the other bidders on the working day following the day of the auction.
 
Registration in the auction begin on 08.03.2022 at 12:00 and ends on 29.03.2022 at 12:00.
 
A person be registered as an auction participant if the application for registration and the necessary annexes to the application meet the conditions for the auction , deposit money has been paid and the person may participate in the auction as a bidder.
 
The auction starts on 29.03.2022 at 14:00 and ends on 05.04.2022 at 14:00.  The interval for the prolonged end is 5 minute(s).
 
The bid step for auctions be 100 EUR(s).
 
Bids can only be made in the auction environment according to the conditions indicated in the auction environment.
 
The winner of an electronic auction pay the purchase price on the working day following the day on which the auction ends, as pursuant to §93(3) of TMS. If the purchase price exceeds EUR 12 700, the auction winner must pay one tenth of the purchase price immediately after the end of the auction, the remaining price having to be paid within 15 days.
 
THE RIGHTS OF THIRD PARTIES
Before the start of the auction, the person must inform the bailiff of his or him rights to the thing to be sold if it have not yet been notified to the bailiff, and the reasons for those rights should be given at the request of the bailiff. Persons holding rights which impede the auctioning shall, in agreement with the claimant or on the basis of a court decision, obtain the termination or suspension of the auctions before the day on which the result is distributed.
