Notice of auction of immovable property in enforcement proceedings

Kohtutäitur Elin Vilippus publishes this announcement under paragraph 153(2) of the Code of enforcement Procedure (TMS).

The bailiff sell the following assets in a https://www.oksjonikeskus.ee in the auction environment of public bailiffs and the Chamber of Bank administrators electronic auction:
The part of the estate owned by Laur Miilmaa (1/2 co-ownership) entered in the register of the Land Registry Division of Tartu County Court No 7184102 (cadastral mark 14001:001:0196), 100% arable land, Harju County, Municipality of Anija, village of Parila, Andrese.
Land area 3.16 ha.

According to the register of buildings, the immovable property includes a dwelling (total area 106.5 m2), an economic building (total area 75.9 m2) and a cellar.

As far as the bailiff is aware, no notarial procedure for the use of immovable property has been concluded between the co-owners, which would have been noted in the land register.

The assets belonging to the debtor shall be encumbered by the rights identified by third parties, with their ranking and other restrictions on the ownership of the immovable property:
“entries in Section I” means road improvements for the benefit of each owner of an immovable property entered on properties Nos 14200102, 7437502, 8724602 and 13275402.
Entry No 1 in Section III - real encumbrance for the benefit of the individual owner of real estate No 14200102. Real encumbrance to ensure the obligation to pay the annual easement fee. the entry made on 15.10.2014 on the basis of the application for registration of 17.11.2014;
Entry No 2 in Section III - preliminary reference for the benefit of the individual owner of real encumbrance No 14200102 in order to secure a change in real encumbrance. Indication to ensure that the fee for servitude is changed in accordance with Article 4 of the contract of 15.10.2014. the entry made on 15.10.2014 on the basis of the application for registration of 17.11.2014;
Entry No 3 in Section III - prohibition on disposing of immovable property in favour of the bailiff Elin Vilippus, Bondora AS (registry code: 11483929), in respect of the part of the property owned by Laur Miilmaa (personal identification No 38105146520). 28.10.2021. entered at the request of the bailiff on 27.10.2021.
Entry No 1 in Section IV - mortgage of EUR 36 000,00 in favour of Hüpoteeklaen AS (registry code 11663703). The individual owner of the property is obliged to submit to immediate enforcement in order to satisfy the claim secured by the mortgage. 14.09.2018. entered on application for registration on 11.09.2018.


The auction shall take place in order to satisfy the claims secured by the disclaimer. A non-binding mark encumbering the part of the estate belonging to the debtor shall be deleted after a successful auction.

A charge on an immovable property amounting to EUR 36 000 REMAINS A CHARGE ON THE PROPERTY after A SUCCESSFUL AUCTION!!

Under paragraph 346(1) of the Law on property rights, the amount of the mortgage is secured by a claim, interest (inter alia, default interest) for up to three years prior to the sale of the immovable property in enforcement proceedings, as well as the costs of recovering the debt, including the costs of the enforcement proceedings and the costs of the enforcement officer and the insurance premiums paid by the mortgagee on behalf of the owner of the immovable property..

To participate in an auction, you must register in an auction environment on the sheet of assets referred to in this notice, the permanent link of which shall be: https://www.oksjonikeskus.ee/oksjon/view/?okid=71197 payment of security of EUR 3 000 into Elin Vilippus account No E321010011610228222 (SEB). Payment explanation: 'Guarantee for 10.01.2023 12:00 participation in auctions ID71197. Real estate: Andrese, Commune of Anija, County Harju'. The deposit shall be deemed to have been settled when it is received. The deposit must have been lodged no later than 10.01.2023 at 12:00. Subsequent receipts shall not be counted. Securities paid by the buyer shall be included in the purchase price and returned to the other bidders on the working day following the day of the auction.
 
Registration in the auction begin on 15.12.2022 at 12:00 and ends on 10.01.2023 at 12:00.
 
A person be registered as an auction participant if the application for registration and the necessary annexes to the application meet the conditions for the auction , deposit money has been paid and the person may participate in the auction as a bidder.
 
The auction starts on 10.01.2023 at 14:00 and ends on 17.01.2023 at 14:00.  The interval for the prolonged end is 5 minute(s).
 
The bid step for auctions be 100 EUR(s).
 
Bids can only be made in the auction environment according to the conditions indicated in the auction environment.
 
The winner of an electronic auction pay the purchase price on the working day following the day on which the auction ends, as pursuant to §93(3) of TMS. If the purchase price exceeds EUR 12 700, the auction winner must pay one tenth of the purchase price immediately after the end of the auction, the remaining price having to be paid within 15 days.
 
THE RIGHTS OF THIRD PARTIES
Before the start of the auction, the person must inform the bailiff of his or him rights to the thing to be sold if it have not yet been notified to the bailiff, and the reasons for those rights should be given at the request of the bailiff. Persons holding rights which impede the auctioning shall, in agreement with the claimant or on the basis of a court decision, obtain the termination or suspension of the auctions before the day on which the result is distributed.
