Keskkonnaamet publishes this announcement under Section 47(2) of the General Law on the Environment (KeÜS).

Keskkonnaamet announces that Osaühing Kroodi Vesi (registry code: 14088607) (address Fosforiidi tn 4, Maardu linn, Harju maakond, 74114) the draft decision amending environmental permit No L.VV/328432 and amended environmental permit No L.VV/328432 have been prepared. Environmental permit No L.VV/328432 was amended in order to remove the limit value for total phosphorus (Pyll) from the table of permitted quantities of pollutants from the inventory stormwater discharge (outlet code HA707) in form 4 of the environmental permit, “emissions and permitted quantities of pollutants by outlet and pollutant”. The stormwater pipeline of the warehouse collects stormwater in the Krood industrial area, i.e. also near the old phosphoride mine. According to the application for amendment of the environmental permit, the water accumulating in the shafts of the phosphoride mine and flooding the industrial area of Krood also penetrates the stormwater pipeline, which is why the release of stormwater from Lao during the period 01.02.2021- 12.06.2023 the total phosphorus content of stormwater exceeded the limit value established by environmental permit No L.VV/328432. As of 08.11.2019, Regulation No 61 of the Minister of the Environment “requirements for waste water treatment and discharge of waste water, rainfall water, mining water, quarry water and cooling water into the receiving water, measures for assessment of compliance with the requirements and limit values for pollutant content” (hereinafter Regulation No 61), subsection 7 (7) of which requires that rainfall water be subject to an environmental permit to determine at least the limit values for the content of suspended solids and petroleum products and BHT7 together with the corresponding monitoring obligation. Other limit values and monitoring requirements for the pollution indicators referred to in Annex 1 to Regulation No 61, namely COD, total nitrogen, total phosphorus and pH, shall be determined in the environmental permit on the basis of the origin and risk assessment of rainfall water. The Environmental Board assessed whether the total phosphorus content above the stormwater limit is due to the shaft of the former phosphoride mine, which infiltrates the stormwater pipeline, taking into account the specific nature of the area, and concluded that the total phosphorus content of the Lao stormwater discharge is affected by the shaft water of the former phosphoride mine and its total phosphorus content..
