Notice of establishing compulsory possession

Muhu Vallavalitsus publishes this announcement under Subsection 2 of § 29 of the Acquisition of Immovables in Public Interest Act (KAHOS).

Muhu Vallavalitsus as a decision-maker announces that it has placed a compulsory usufruct in favour of the Elektrilevi OÜ (registry code: 11050857). 28 January 2025 by order No 30 Muhu Parish on the route in Kuivastu village (Registration number 3753534 of the land registry department of Tartu County Court, cadastral unit ID 47801:008:0669)
Compulsory possession for an unspecified term shall be established in favour of Elektrilevi OÜ for the toleration of a new land cable line with a voltage of 10 kV (i.e. for construction, installation, subsequent maintenance and, if necessary, reconstruction). The spatial data identifier of the area of compulsory possession in the LAND cadastre restricted real Rights spatial information System PARI is 373761.
An entitled person is required to:
use the part of an immovable encumbered with compulsory possession for the intended purpose, preserve its economic purpose and take reasonable measures to ensure the operation of land cable lines;

to protect and/or relocate land cable lines in accordance with the procedure provided by law;
in the event of the end of compulsory possession, liquidate the factory facilities and restore the land if the liquidation of the factory facility is necessary upon the end of compulsory possession;

ensure restoration of the good order of the land unit and maintenance of the area of use of the land unit during the period of validity of compulsory possession after the work related to the factory installation at its own expense;

pay the owner of the immovable a periodic levy on compulsory possession equal to the charge paid for the immediate statutory obligation to tolerate the utility network or utility under the same conditions pursuant to § 15 ´ 5 of the Law of property Act implementation Act. Payment of the fee shall be made pursuant to the procedure provided for in § 15 ´ 6 of the Law of property Act implementation Act.

The owner of an immovable may grant other rights of use to the area of compulsory possession which do not hinder the exercise of compulsory possession.
