Pärnu Maakohtu maksekäsuosakond publishes this announcement under Subsection 3 of § 317 of the Code of Civil Procedure (TsMS).

The court delivers to the debtor, RA BBQ OÜ (registry code: 12093403), publicly served 27.03.2025 court order (payment order) in civil case no. 2-25-109502. The payment order will be deemed to have been delivered in public 15 days after the date of publication of this announcement (§ 317(5) of the TsMS).

On the basis of the application for an order for payment lodged with the 26.03.2025 Pärnu Country Court and pursuant to the Code of Civil Procedure (§ 484 of the TsMS), the court RA BBQ OÜ (registry code: 12093403) proposes that the debtor pay to the applicant, within 15 days of receipt of the Karisma Food OÜ (registry code: 12278092) order for payment (30 days in the case of foreign service), a principal claim of EUR 257,89 and ancillary claims of EUR 65,00, as well as reimbursement to the applicant of the 1 487,30 of the court fees and the costs of the proceedings of EUR 20.00. The claimant's claim is based on Transfer contract (Sales contract, 27.09.2024); Invoice (No. MA_K534331 MA_K535138).

Upon receipt of a payment proposal, the debtor shall have the opportunity to:
(1) pay the claimant the amount indicated in the payment application within 15 days (30 days in the case of foreign service) of receipt of the payment application if you consider the claim to be well founded or
(2) within 15 days (30 days in the case of foreign service) of receipt of the payment application, object to all or part of the claim if you do not consider the claim to be well founded.

The objection must indicate to the court whether and to what extent the debtor contests the claim. The statement of opposition must be made on a form provided for that purpose, available electronically on the www.kohus.ee website and attached to this notice. An objection may be lodged with the court by electronic means, either by e-mail (address: (maksekask@kohus.ee) or via a public e-file (address: www.e-toimik.ee). An objection filed electronically must be signed in digital form. An ID card or mobile-ID can be used to enter the public e-file. Where it is not possible to use an electronic form, the objection may also be made in another form. The paper-signed objection must be lodged with the order for payment department of the Maakohus de Pärnu, Port 21, Haapsalu.

Payment of the debt shall be notified forthwith to the declarant and to the court.

If the debtor fails to pay to the claimant the amount indicated in the payment order or does not lodge an objection within the prescribed period, the court shall, on the basis of the payment order, issue an order for payment which shall be enforceable immediately, irrespective of its service on you (§ 489(7) of the TsMS). If the application seeks an order requiring the debtor to pay default interest as a percentage of the principal claim until performance of the principal claim, the default interest due from the debtor by means of the order for payment increases.

Under § 320(2) of the TsMS, the court is to order the debtor to appoint a person authorised to accept service of pleadings, on the ground that the proceedings have caused unjustified difficulties in the service of pleadings on him. The court must be informed of the first name, surname and personal identification number of the person authorised to accept service of procedural documents, as well as of the exact address to which further documents are to be forwarded. If the debtor does not designate such a person, subsequent procedural documents shall be served on the debtor by post in ordinary form at the debtor's own address (§ 320(3) of the TsMS).

The payment proposal is available from the payment order department of Pärnu Country Court located at Haapsalu couthouse (Sadama 21, 3rd floor, Haapsalu). The document is also available in the public e-file (http://www.e-toimik.ee). An ID card or mobile ID can be used for entrering the system.
