Notice of an auction for an immovable in bankruptcy proceedings

Veroonika Puiste (national identification 47805256019) pankrotihaldur Küllike Mitt publishes this announcement under Subsection 1 of § 136 of the Bankruptcy Act (PankrS) and subsection 2 of § 153 of the Code of Enforcement Procedure (TMS).
 
The bankruptcy trustee, in the public electronic auction, sell https://www.oksjonikeskus.ee in the auction environment of the Chamber of bailiffs and bankruptcy administrators assets in bankruptcy:
registered part No 1510139 of a built-up registered immovable (single dwelling), located in Viljandi County, North Sakala Rural Municipality, Suur-Jaan City, J. Köleri tn 23, cadastral code 76001:003:0140, intended purpose - residential land 100%, size 3333.0 m ².

The following are entered in the third section of the land register:
1) an unlimited and gratuitous personal right of use in favour of Valdo Mei (ik 36704150260) pursuant to clause 3.1 of the 07.08.2019 Agreement. Upon the sale of an immovable for an unspecified term and free of charge, the personal right of use shall be deleted pursuant to subsection 139 (2) of the PankrS.
2) a notation concerning the declaration of bankruptcy of the Veroonika Puiste of the owner of the registered immovable. Upon sale of a registered immovable, a bankruptcy notice shall be deleted pursuant to § 40 (3) of the PankrS.

The following are entered in the fourth section of the land register:
1) a ranking 1 mortgage in the amount of EUR 18 200 in favour of Luminor Bank AS (RK 11315936). Upon sale of the registered immovable, the mortgage shall be deleted pursuant to § 139 (2) of the PankrS.
2) a ranking 2 mortgage of EUR 45 000 in favour of Hüpoteeklaen AS (RK 11663703). The mortgage is in turn encumbered with a pledge in favour of Burfa real estate OÜ (RK 14295045). Upon sale of the registered immovable, the mortgage shall be deleted pursuant to § 139 (2) of the PankrS.

The property is located about 25 km from the county centre in the city of Suur-Jaan, from the city centre of Viljandi. The nearest school and nursery are located about 1.1 km away from the property, the nearest shop and public transport stop is about 700 m away from the property. The nearest body of water is the Great Jaan barrier lake about 400 m away. Access to the property is from a public street; there is no need to set an easement.

A single dwelling is located on the property (code 120645014 of the register of construction works). The state of the building - present. A permit for use has been issued for the construction work on 28.03.2024. Energy performance certificate not entered in register of construction works, according to project data D (a label based on energy calculation has been issued on 25.10.2011.).

10.01.2024. the draft amendment was made to preliminary project E28-11 (the project has been brought into line with reality). In particular, the boundaries of the interior of the building, the direction of the turn of the stairs between the two floors and the number of opening fills related to the exterior of the building were changed; one upstairs room window and two smaller basement windows on the south side of the building have been added to the installation of opening fillers; the terrace planned on the western side of the building has been abandoned and its construction will be resolved in the future; the internal stairs leading to the basement floor and skylights have been abandoned; an air-heat pump is installed.

The number of ground floors of the building is 2, the number of underground floors is 1. According to the Register of Construction works, the area under construction is 99.6 m ², the closed suletud netopind is 226.9 m ², the heated area is 167.2 m ².

“Spatial plan of the building” means a room, kitchen/hall, toilet shower room, san.oil m and chamber on the first floor (89.5 m ²); The II floor (77.7 m ²) has 3 rooms and an open room/staircase hall; the basement floor (59.7 m ²) has a cellar front room, basement and auxiliary room.

Single-occupancy structures: “foundation” means a lower foundation; “material for carrying and stiffening structures” means wood; a brick; “type of external wall” means a barn; “roof and intermediate ceilings” means timber; “roof cover” means bituminous plates; “exterior finishing” means wood; doors and windows - front door of wood, interior doors lightweight, package windows. In part, the construction of wind boxes is unfinished, with color differences on the facade. Outdoor and indoor stairs are made of wood with wooden railings. “Interior decoration” means table floors, ceramic tiles, particle board in one room in dwellings; wallpaper, colorants, tiles, insulation material in one room for wall coverings; ceiling in the barn, paint cover, ceiling plate, insulation material in one room; ceramic tiles for covering floors and walls in sanitary rooms, ceiling in a barn. There's sanitary equipment. No fixed kitchen furniture. The overall condition of the interior finish is in good/satisfactory condition. No finish in one room. The modular chimney is unfinished.
Water supply - network (closed as of now, opening is not costly), plus a well on the property. Sewerage - network (currently closed, opening is not costly). Power supply - grid. According to the audit carried out in accordance with 26.02.2024. the electrical installation of a single dwelling or part thereof complies with the safety requirements. Gas supply - None. Heat supply - local heating. Heat source - a cast iron stove/fireplace is used as a fireplace on the ground floor, installation according to the manufacturer's instructions. Air-to-air heat pump used as main heating. In addition, electric floor heating on surfaces covered with ceramic tiles. Energy source - solid; air heat + electricity. Ventilation - natural ventilation (incl. without natural draught flues); type of cooling system - air cooling with ventilation.

In addition, an outbuilding (building register code 112026200) is entered in the register of construction works, which does not exist in practice. Smaller outbuildings not entered in the register of construction works are located on the registered immovable..

A person be registered as an auction participant if the application for registration and the necessary annexes to the application meet the conditions for the auction , deposit paid and the person may participate in the auction as a bidder.

The winner of an electronic auction pay the purchase price on the working day following the day on which the auction ends, as pursuant to §93(3) of TMS. If the purchase price exceeds EUR 12 700, the auction winner must pay one tenth of the purchase price immediately after the end of the auction, the remaining price having to be paid within 15 days.
